It is just a matter of time and many are not surprise. Both Charlie Sheen and wife Brooke Mueller have filed divorce petitions on Monday (November 1), citing "irreconcilable differences" and the date of their separation is December 25, 2009 --the date of their violent fight in Aspen.

Charlie Sheen and wife Brooke are "not seeking a divorce"
Even though Charlie Sheen and wife Brooke Mueller are living in separate homes as they "trying to work things out", the two camps denies financial agreements and they are no plans to divorce.
In a joint statement released by Mueller’s attorney, Yale Galanter, and Sheen’s friend/producer, Mark Burg: "Please let us clarify this: They are not seeking a divorce nor has one been contemplated. There has been no financial agreements between the parties of any sort. Stories to the contrary are false. This is a difficult time and they need space to see if they can work things out or not."
It seems they keeping the issues under the radar until Sheen’s criminal charges is over.

Charlie Sheen Pleads Not Guilty on domestic violence charges.
Charlie Sheen pled not guilty for the Christmas day incident with wife Brooke Mueller. He has been charged with felony menacing, third degree assault and criminal mischief.
Trial date has been set for July 21.
Meanwhile, the 44-year-old actor will return filming his CBS sitcom "Two and a Half Men" to finish the scheduled four episodes.

Brooke Mueller suing rehab center for violating her privacy
Charlie Sheen's wife Brooke Mueller is planning of suing Canyon rehab facility after personal details of her status was leaked (privacy breach) to media outlets. Brooke left the rehab and reportedly she is in a new facility.
Her stepfather Jon Fiore tells radaronline, “She's is doing well and she's staying with a friend out in California and she is getting herself together."

Brooke's lawyer, Yale Galanter, tells TMZ, "Brooke was forced to leave The Canyon rehab facility because of the security breach." As TMZ first reported, someone from the facility leaked Brooke's admission form to the media, which contained very personal information about her substance abuse.Talking about the new facility, Galanter said, Brooke is "in a private, more secure, confidential environment"
Galanter says he will file a lawsuit on behalf of Brooke against The Canyon and plans "to have the individual responsible for leaking the information arrested."

Charlie Sheen formally charged (Felony Menacing & Two Misdemeanors)
The Aspen court officially charged Charlie Sheen in the Christmas day incident which he allegedly threatened to kill his wife Brooke Mueller.
Sheen was formally charged with felony menacing and two misdemeanors: 3rd degree assault and criminal mischief. The court prevent Sheen from drinking and owning a gun.
Giving Sheen some break, the protective order is now lifted and he can communicate with Brooke.
The next court hearing is scheduled for March 15.

Charlie Sheen’s wife Brooke Mueller is indeed has checked into a North Carolina rehab center, not for addiction but for her pneumonia.
Mueller's lawyer Yale Galanter reiterate that her client will undergo a wellness program.
Brooke Mueller was recently hospitalized due to pneumonia after having an oral surgery complication.
The mission statement of Two Dreams reads, "Two Dreams is a comprehensive wellness program providing exemplary care for individuals who dream of recovery from addictive disorders or co-dependent behaviors."

Charlie Sheen's wife still in ICU; court allowed sheen to communicate with Mueller
Brooke Mueller is still suffering from pneumonia and kidney infections after having a 105-degree fever. She is currently admitted in a Los Angeles hospital. The infection she contracted relating to an oral surgery procedure she had earlier this week.

Her mother Moira Fiore said, "I talked to her doctor, and they are filling Brooke with antibiotics. She waited too long to get her impacted wisdom tooth removed and the infection has spread all over. It is in her bloodstream."The Aspen court allowed Charlie Sheen to communicate with his wife Mueller, suspending temporarily the restraining order filed against him over the Christmas domestic incident. The court order also stated, "Defendant shall terminate any contact immediately upon the request of Ms. Sheen or any of her health care providers."

Charlie Sheen must appear in court
It seems Charlie Sheen felt that it is just a small problem that he can handle by phone but the Colorado court wants him to appear in person for the January 20th court appearance in Aspen Colorado.
Sheen requested that he will just participate to the said hearing via telephone to talk about the restraining order filed by his wife Brooke Mueller over the Christmas day altercation.
Brooke Mueller wants to dismissed the said restraining order so that they can work things out and save the marriage.
Charlie must also attend the hearing scheduled for February 8th.

Charlie Sheen is in the hot seat over the Christmas altercation with his wife Brooke Mueller. Do you that Brooke Mueller has her own problem with the law in the past.
Brooke was arrested twice, once for DUI and damage to property in September 1996 and after that on an outstanding warrant for cocaine possession, a 3rd degree felony, in March 2001.
Meanwhile, the couple wants to save their marriage and their lawyers filed for the dismissal of the couple's protective order. Reportedly, $1 million deal was offered to enhanced their marriage.

According to RadarOnline, $1 million deal was added by the Charlie's camp on the "prenuptial agreement if he stays out of prison and they remain married."Brooke's lawyer Yale Galanter said, "They’re very much in love, and they want to try to work it out. I think they had a really bad day, which is probably an understatement, but they need their privacy and they need some time."
"They want to act as husband and wife, and with the restraining order there, that’s tough to do. I believe their relationship is still strong... They love each other. They’re married. They have two beautiful babies.""

The child services department is closely keeping an eye on the Charlie Sheen's domestic incident and their are ready pursue a thorough investigation.

Pitkin County Department of Social Services is "aware" of the alleged incident between Sheen and his wife Brooke Mueller -- and the department is considering whether to pursue an investigation, TMZ reports.The couple have 9 month-old twins (Max and Bob) and Charlie's daughters, Sam, 5, and Lola, 3 (with ex-wife Denise Richards).
"When there is a domestic dispute and children are present in the home, we are always notified."

Brooke Mueller Claimed Charlie Sheen Threatened Her With A Knife
One of the felony charge which Charlie Sheen will be facing is felony menacing -- a threat involving a deadly weapon, according to TMZ.Charlie's wife Brooke Mueller told cops that her husband was in possession of a knife and threatened her with it.
The incident is the hot issue of the moment but their not thinking for divorce. Charlie's manager-friend Mark Burg told RadarOnline, "I have spoken to all parties concerned. There are no plans for divorce. They are both deeply upset about what happened and are trying to work things out amicably."

Charlie Sheen Arrested on Domestic Violence Charges; Choking incident!
Charlie Sheen (real name: Carlos Irwin Estevez) was released from jail after being arrested on domestic violence charges Friday morning (Dec. 25) in Aspen, Colorado against his wife Brooke Mueller. He posted an $8,500 bond.
The Two and a Half Men actor was booked for second-degree assault, menacing and criminal mischief, according the Pitkin County Authorities.
Sheen got engaged to Mueller in 2007, they married in 2008 and earlier this year Brooke gave birth to twin boys (Max and Bob).
UPDATE: According to Radaronline, "Charlie Sheen’s wife Brooke Mueller claimed that the actor choked her, leading to his arrest on felony domestic abuse charges."
