Gary Dourdan was given a warning by the court

Ex-CSI star Gary Dourdan got lucky and escaped deeper penalty after violating a protection order stemming from a felony domestic violence charges filed by his former GF.

According to TMZ, "Gary sent his ex-GF a text message on December 24th -- wishing her a "Merry Christmas" -- and then called her... The actor would be remanded into custody if he tried to contact her again."

Nicole Vail Cannizzaro obtained a restraining order against the actor after Dourdan broke her nose back in November. 3 years protective order was issued against Gary.

Next hearing is set February 15.
